These Terms of Service (“Terms”) govern your access to and use of The Foyer (the “Service”), operated by Digital Nomad LLC (“The Foyer,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who may use the Service
You must be at least 18 years old and able to enter into a binding contract to use the Service. By using it, you represent that you meet these requirements.
Your account
When you create an account, you agree to provide accurate information, keep your credentials secure, and remain responsible for all activity under your account. Notify us promptly of any unauthorized use.
About the information on the Service
The Foyer aggregates information about schools from publicly available sources and from the schools themselves, and presents it to help families with their search. We are an independent service and are not affiliated with, endorsed by, or acting on behalf of any school. Admissions dates, tuition, program details, and other information may be incomplete, outdated, or inaccurate, and can change at any time without notice. The Service is provided for general informational purposes only and is not professional, legal, or admissions advice. Always verify details directly with a school before making any decision. We do not guarantee admission to, or any outcome with, any school.
Content you provide
You retain ownership of the content you submit, such as reviews, forum posts, and notes (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it in connection with operating and promoting the Service. You are solely responsible for your User Content and represent that it is accurate, lawful, and does not violate anyone's rights. You agree not to post content that is false, defamatory, harassing, infringing, or otherwise unlawful. We may remove User Content or suspend accounts at our discretion.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Scrape, harvest, or systematically extract data from the Service, or access it through automated means, except as expressly permitted;
- Interfere with or disrupt the Service, or attempt to gain unauthorized access to it;
- Impersonate any person or misrepresent your affiliation; or
- Collect or misuse other users' information.
Paid subscriptions
The Service offers an optional paid plan (“Pro”). By subscribing, you authorize us and our payment processor (Stripe) to charge the applicable fees.
- Billing and renewal. Subscriptions are billed in advance on a recurring basis (for example, monthly or yearly) and automatically renew until cancelled.
- Cancellation. You may cancel at any time through your account's billing settings. Cancellation stops future renewals; you retain access to Pro features through the end of the period you have already paid for.
- Refunds. Except where required by law, fees are non-refundable, including for partial billing periods.
- Price changes. We may change subscription prices; changes apply to future billing periods and we will provide notice as required.
Intellectual property
The Service, including its design, text, graphics, and software (excluding User Content and third-party materials), is owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.
Third-party links and services
The Service may link to third-party websites and rely on third-party services. We are not responsible for the content, policies, or practices of any third party.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty as to the accuracy, completeness, or reliability of information on the Service.
Limitation of liability
To the fullest extent permitted by law, The Foyer and Digital Nomad LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunities, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.
Indemnification
You agree to indemnify and hold harmless The Foyer and Digital Nomad LLC from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New York, New York, and you consent to their jurisdiction.
